Registration Agreement-en
(the "Agreement")
Welcome to Invest in China! To use
the services provided by the Website, visitors accept the terms of
the Agreement, register as a website member and abide by the terms
described herein. If you cannot accept the terms hereof, please do
not use the Website. After accepting the terms hereof, you will
comply with the relevant provisions.
I. Acceptance
The Services provided on the Website
are in full accordance with the terms and operating rules it has
published. For the purpose hereof, users refer to those who fully
agree to all the terms and complete the registration process.
2. Alterations and modifications
The Website reserves the right to
modify the terms of service at any time. When there is a change in
the terms of service, the Website will make available the
modifications on the page; when users use special services offered
on the Website, they must accept the rules or instructions related
to the special services so provided at any time, and these rules
or instructions constitute part hereof. If any user does not agree
to the modification, he can actively cancel the network service
already obtained; if the user continues to enjoy the network
service, it is deemed that he has accepted the said modifications.
3. Services
(1) The Website uses its own system
to provide users with rich online resources and personalized
content via the Internet (hereinafter referred to as the
"Services"). Unless expressly stated otherwise, any new feature
that reinforces or enhances current Services, including new
products, will be governed by the Agreement unconditionally.
(2) The Website disclaims
responsibility for the network services and investment promotion
services provided; that is to say, the users will assume risks of
using the Services. The Website does not guarantee that the
Services will meet the user's requirements, nor that the Services
will not be interrupted, and it does not guarantee the timeliness
and accuracy of the Services.
(3) In order to use the Services, a
user must:
a. be equipped with equipment
necessary to access the Internet, including computers, modems or
other access devices;
b. pay fees related to the
Services;
(4) To accept the Services, a user
must agree:
a. to provide complete, true,
accurate and up-to-date personal information;
b. to continuously update the
registration information to meet (4).a above.
c. if a user provides any false,
untrue, out of date or incomplete information, which is confirmed
by the Website, or the Website has reasonable reason to suspect
that the information is false, untrue, out of date or incomplete,
the Website is entitled to suspend or terminate your account and
reject all or any part of the Services he is using now and about
to use in the future.
4. All users must abide by the
following laws and regulations:
Users agree to abide by the Secret
Law of the People's Republic of China, State Secrecy Protection
Regulations on Computer Information Systems on the Internet, the
Regulations of the People's Republic of China for Safety
Protection of Computer Information Systems, the Administrative
Measures for the Protection of International Networking Security
of Computer Information Networks, the Interim Administrative
Regulations of the People's Republic of China on International
Networking of Computer Information Networks and their implementing
measures, as well as other laws and regulations on networking and
their implementing measures. In any case, the Website reasonably
believes that the user's actions may violate the above laws and
regulations, and may at any time terminate the provision of the
Services without prior notice.
5. User privacy right system
When a user signs up for the
Services on the Website, personal information must be provided. If
a user provides any false, untrue, out of date or incomplete
information or the Website has reasonable reason to suspect that
the information is false, untrue, out of date or incomplete, the
Website is entitled to suspend or terminate its account and reject
all or any part of the Services it is using now and about to use
in the future.
The purpose of collecting personal
information on the Website is to provide users with a variety of
investment promotion services. Without the legal authorization of
users, their personal information and non-public content stored on
the Website will not be disclosed, unless:
a. otherwise required by the
relevant laws or legal service procedures of the Website;
b. otherwise required to protect
the rights and interests of users and the public in emergency
situations;
c. otherwise required to maintain
the trademark rights of the Website;
d. in other circumstances that
require disclosure, editing or disclosure of personal information.
6. User account, password and security
(1) Once a user has successfully
registered, it will become a legal user of the Website and will
receive a password and account. It is the user's responsibility to
keep the password and account secure. The user is fully
responsible for all activities performed using his password and
account; therefore, the Website will not and does not bear any
responsibility for any loss or damage arising therefrom.
(2) The use of a user's password
and account without authorization or any other security issues, if
any, can be immediately notified to the Website, and the user is
suggested to log out after each disconnection; otherwise the user
may not be protected by the Website.
7. Storage and restriction of user
information
The Website is not responsible for
failure to delete or store information posted by users. The
Website has the right to determine whether a user's behavior
complies with the Agreement. If a user is deemed to have violated
the provisions hereof, the Website is entitled to suspend the
provision of network services to it.
8. Users are prohibited from engaging
in the following activities:
(1) uploading, posting, sending
email or transmitting any illegal, harmful, coercive, harassing,
slanderous, vulgar, obscene, defamatory materials or those that
infringe on others' privacy or contain racial discrimination or
other offensive contents, including but not limited to
information, data, text, software, music, photos, graphics,
information, or others ("contents").
(2) harming the minor in any way.
(3) impersonating any person or
institution, or misrepresenting or misleading their connection
with any person or institution in a false manner.
(4) faking the title or
manipulating the identification information in other ways to make
people mistakenly believe that the content is transmitted by the
Website.
(5) uploading, posting, sending
email or otherwise transmitting the contents that are not
authorized to be transmitted (such as internal information,
confidential information).
(6) uploading, posting, sending
email or otherwise transmitting any contents that infringe any
person's patent, trademark, copyright, trade secret or other
exclusive rights.
(7) uploading, posting, sending
email or otherwise transmitting advertising, marketing materials,
"spam mails" and others, except the exclusive area for the
aforementioned purpose.
(8) uploading, posting, sending
email or otherwise transmitting information about software viruses
or other computer codes, files and programs that interfere with,
destroy or limit the function of any computer software, hardware
or communication equipment.
(9) interfering with or disrupting
the Services or servers and networks connected to the Services, or
failing to comply with the rules for the network use of the
Services.
(10) intentionally or
unintentionally violating any relevant Chinese laws, regulations,
rules, ordinances and other legally valid norms.
(11) following or otherwise
harassing others.
(12) users are fully responsible
for the contents uploaded, posted, emailed or transmitted via the
Services.
(13) As for the contents
transmitted through the Services, the Website does not guarantee
the accuracy, completeness or quality thereof. When a user accepts
the Services, under no circumstances will the Website be
responsible for any contents, including but not limited to any
errors or omissions in any contents and any loss or damage arising
therefrom. The Website has the right but not the obligation to
refuse or delete any contents provided by the Services. Users use
the above contents at their own risks.
(14) The Website is entitled to
save or disclose the contents in the following cases:
a. as provided by legal procedures;
b. as provided by the Agreement;
c. claims made by the third party
who has been violated;
d. as required to protect the
rights, property, or personal safety of the Website and its users,
and the public.
e. other circumstances deemed
necessary by the Website.
9. With respect to the contents posted
by users in public use areas:
(1) "Public use area" means an area
available to the general public;
(2) Where a user posts contents in
the use area made available by the Services, it shall be deemed as
granting right to use for free and non-exclusive right to use and
to copy, modify, and publish the above contents.
(3) The user assumes full
responsibility for any damages or losses arising from claims
lodged by any third party as a result of the above posting by the
user.
10. Without the express authorization
of the Website, no institution or individual may duplicate, copy,
sell, resell or use for any commercial purpose the information or
services provided by the Website. No media, Internet site, or
commercial organization may use the information and service
provided on the Website for commercial reprinting, nor may they
distort and tamper with the contents published on the Website.
11. The Website is entitled to specify
and modify the general measures for using the Services, including
but not limited to the decision to retain e-mail messages or other
uploaded content, and to limit the number of e-mails that can be
received by one account. If the Website fails to store or delete
the content or other information in connection with the Services,
it will not bear any responsibility. The Website has the right to
delete a user's account that has not been used for 3 months.
12. Links
The Services may provide links to
other Internet sites or resources. The Website does not guarantee
the availability of the aforementioned websites or resources and
will disclaim liability for any loss or damage caused by using or
relying on the above websites or resources.
13. Intellectual property rights and
other rights
(1) The Website has corresponding
rights to the Services and the software used by the Services,
including materials protected by intellectual property rights or
other laws;
(2) The information and content
transmitted through the Services are protected by copyright law,
trademark law, patent law or other laws; without the express
authorization of the Website, no users may modify, rent,
distribute or derive other works.
(3) The user has the non-exclusive
right to use the software used in the Services, but may not or
permit any third party to copy, modify, sell or derivate products.
(4) The Website, the design drawing
of the Website, and other products and services of the Website,
are trademarks enjoyed by it. No one may use, copy or use them for
other purposes.
14. Disclaimer
(1) The Website does not represent
or guarantee the correctness or reliability of any contents,
information or advertisements contained, via or connected,
downloaded or obtained in connection with the Service and the
Website does not assume any responsibility for any products,
information or materials purchased or obtained through
advertisements, displays on the Services. Users assume the risk of
using the Services.
(2) The Website has the right but
not the obligation to improve or correct any omissions or errors
in any part of the Services.
(3) The Website does not guarantee
(including but not limited to):
a. the compliance of the Services
with users' use requirements;
b. the uninterrupted, timely, safe,
reliable or error-free provision of the Services, including
hacking, network interruption, telecommunications problems and
other force majeure;
c. satisfaction of users'
expectations by any products, services or other materials obtained
by the user through the Services;
(4) Users use any materials
downloaded or obtained through the Services at their own risks and
will take full responsibility for damage to their computer system
or loss of data due to such use;
(5) The Website does not bear any
direct, indirect, incidental, derivative or punitive compensation
for profits, business reputation, loss of data or other tangible
or intangible losses caused by:
a. use or unavailability of the
Services;
b. any products, materials or
services purchased or obtained through the Services;
c. unauthorized use or modification
of the user data;
d. other matters related to the
Services.
(6) When browsing the Internet, the
user shall use the search directory at its own discretion. The
said directory may lead users to websites that are considered
offensive or inappropriate. The Website is not obliged to view the
content of the websites listed in the search directory, and
therefore, is not liable for its correctness, legality, and
legitimacy.
15. Users agree to compensate and hold
harmless the Website and its branches, affiliates, agents, or
other partners and employees from any claims lodged by any third
party due to their release or transmission of contents via the
Services, connection with, violation of the Services, or
infringement of any rights of others.
16. Modification and termination of the
Services
The Website is entitled to modify or
terminate the Services (or any part thereof) temporarily or
permanently at any time, with or without notice. Modifications or
termination of the Services by the Website will not bear any
responsibility to the user and any third party. The Website has
the right to terminate the user's account, password, or use of the
Services, or delete or transfer the content stored by the user and
posted on the Website for any reason. The Website will not issue
any notice for the above actions and will not assume any liability
for any third party.
17. Notices
The notices sent to users by the
Website are in the form of emails or page announcements or regular
letters. In the event of any changes in the terms of service or
other matters, the Website will make them available in the above
form.
18. Applicable laws and jurisdiction
The entry into force, performance,
interpretation hereof as well as the disputes resolution will be
governed by the laws of the People's Republic of China. Any and
all disputes will be submitted to Beijing Arbitration Committee,
whose arbitration award is final. In the event that any terms
hereof are partially invalid due to conflict with the current laws
of the People's Republic of China, the validity of other parts
will not be affected.
